Mr.L.B.Dabhi, learned APP waives service of rule on behalf of the respondent - State.
[2] Present application is filed by the applicant for deleting / modifying condition nos.7(d) and condition no.7(e) imposed vide order dated 02.08.2001 passed by this Court in Criminal Misc. Application No.5757 of 2001.
[3] It is submitted by the learned advocate for the applicant that applicant has not breached any conditions imposed by this Court and has complied all the conditions. Nothing adverse is reported against the applicant accused.
[4] Having heard learned advocates for the respective parties and considering above, condition no.7(d) in the order dated 02.08.2001 passed by this Court in Criminal Misc. Application No.5757 of 2001 is deleted and condition no.7(e) in the order dated 02.08.2001 passed by this Court in Criminal Misc. Application No.5757 of 2001 is modified to the extent that the applicant shall not leave India without prior permission of the Court concerned. Rule is made absolute to the aforesaid extent. Present application is disposed of accordingly. Direct service is permitted.
