JUDGMENT / ORDER

Manjula, 46 years W/o. Velu Swamy, R/at. No.22, Anjaneya Temple Road, Bengaluru -560 006. …Respondent (By Sri. V. Prakash Rao Jadhav, Advocate –Absent) This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C. praying to set aside the judgment dated 14.02.2019 passed by the learned 65th Additional Sessions City Civil Judge at Bengaluru (CCH-66) in Criminal Appeal No. 1470/2016 and also the judgment of conviction dated 15.11.2016 passed by the learned 21st Additional Chief Metropolitan Magistrate at Bengaluru in C.C. No.4455/2016 and consequently acquit the petitioner.
This Criminal Revision Petition coming on for orders this day, the Court made the following:
ORDER Though this case is posted on 20.08.2019, 26.08.2019 and also today there is no representation on behalf of the petitioner/accused and even office objection raised on I.A. No.2/2019 for compounding the offence has not been complied with. The conduct of the petitioner/accused and respondent shows that the matter might have been amicably settled between the parties and they have filed application under Section 147 of Negotiable Instruments Act, 1881. Neither the petitioner/accused and her counsel nor the respondent and her counsel are present on all the dates of hearing. It shows that they are not interested in the matter.
Under such circumstances, I fell that there is no reason to adjourn the case. Hence, the petition is dismissed.
Further, liberty is given if both the parties are present and comply the office objection and approach this Court to record the compounding of offence, the same is permitted if any such application is filed.
