Heard Sri Nirbhay Kumar, learned counsel for the petitioner and Sri Gaurav Pratap Singh, learned A.G.A. appearing for the State.
It is pointed out by learned A.G.A that earlier the petitioner has filed Criminal Misc. Writ Petition No. 13678 of 2020 challenging the impugned F.I.R in which interim order has been passed by the co-ordinate Bench of this Court vide order dated 26.11.2020 and this is the second petition on behalf of the petitioner for the same cause of action but the said fact has not been disclosed by the petitioner in the present petition to which learned counsel for the petitioner states that he has no knowledge about the same and tendered his unconditional apology on behalf of the petitioner and prays that the petition may be dismissed as not pressed.
Accordingly, the present petition is dismissed as not pressed with caution to the petitioner not to repeat such act in future.
