Petitioner has already been offered compassionate appointment on the post of Sweeper on 26th March, 2019. Such appointment has been accepted by the petitioner without any protest and she has been working as such for the last about two years. An application has now been given by the petitioner for her claim to be considered for appointment on the post of Peon as similar claims have been considered in the past. Prayer is made to command the respondent no. 2 to decide petitioner's application.
Petition is opposed by Sri Rahul Srivastava, learned counsel for the respondent.
Object of compassionate appointment is to enable the family of the deceased to tide over the sudden difficulty caused due to death of sole earning member and such appointment otherwise cannot be claimed as a matter of right. The respondents have already considered petitioner's claim and she has been granted appointment in the regular scale of pay of Rs. 18000-56900 on 26.3.2019 and she has been working as such since then. Petitioner having acquiesced to such appointment and without laying any challenge to it cannot be permitted to question said appointment or to claim appointment on a higher post.
Writ petition lacks merit and is, accordingly, dismissed.
