Heard Sri Radhey Shyam Yadav, learned counsel for the petitioner and Sri Nishit Yadav, has appeared for the U.P. Public Service Commission.
The petitioner has applied on-line pursuant to the advertisement no.A-2/E1/2017 issued by the U.P. Public Service Commission. The aforesaid advertisement provides that in addition to on-line application, the candidate has to submit hard copy of the same along with the documents in respect thereof by a particular date and in case the documents are not so submitted, the candidature would stand rejected. The petitioner admittedly submitted the hard copy and the documents after prescribed date.
In view of the above, that the petitioner has preferred this petition seeking direction to accept the hard copy and the documents and to permit her to appear in PCS main examination to be held on 17.05.2018.
A Full Bench of this Court in the case of Rajendra Patel Vs. State of U.P. And Another 2015(8) ADJ 219 has clearly laid down that where the Commission in addition to the on-line applications require the candidates to submit hard copy also and the last date is prescribed for it, the candidate is required to comply with the said condition strictly and if the hard copy is not delivered to the Commission within the time provided, the submission of the application would not be a valid one and the Court in such circumstances cannot direct that such an application should be entertained.
We have already dismissed Writ -A No.-8715 of 2018 (Jayadeep Garewal Vs. State of U.P. and two others) vide order dated 28.3.2018 in view of the above Full Bench decision.
In view of the aforesaid, as the hard copy of the application sent by the petitioner was not delivered to the Commission within the time prescribed it was rightly not accepted and this Court is not supposed to issue any direction for entertaining it beyond the time prescribed. Accordingly, the petition lacks merit and is dismissed. In case the petitioner has suffered any loss and is advised, she may pursue the remedy so as to claim damages.
