JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 35028 of 2002 Petitioner :- Kumari Neena Katheria Respondent :- Director Of Education Secondary Alld. And Others Counsel for Petitioner :- P.C. Pathak,Rajesh Kumar Yadav,V.K. Shukla Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“(a) issue a writ, order or direction in the nature of certiorari calling for the record of the case and to quash the order dated 25.7.2002 passed by District Inspector of Schools Farrukhabad (Annexure-16 to writ petition) and order dated 1.8.2002 passed by Manager, Committee of Management Swami Ramanand Girls Inter College, Farrukhabad (Annexure-16 to writ petition) and order dated 21.3.2002 passed by Director of Education (Secondary) Allahabad (Annexure-12 to writ petition).
(b) issue a writ, order or direction in the nature of mandamus commanding and restraining the respondents not to interfere in the peaceful functioning of the petitioner as Assistant Teacher B.T.C. grade in attached Primary Section affiliated Swami Ramanand Girls Inter College, Farrukhabad.
(c) issue a writ, order or direction in the nature of mandamus commanding the respondents to ensure payment of the salary to the petitioner w.e.f. 17.7.2001 upto date and also for future months alongwith other Teaching and non Teaching staff of the institution namely Swami Ramanand Girls Inter college, Farrukhabad.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 22.2.2019 PS
