This Criminal Original Petition has been filed to direct the respondents herein to give adequate police protection to the petitioner and his workmen during the fencing work at his land in S.No.187, Kendaiyanahalli Village, Pennagaram Taluk, Dharmapuri District in pursuant to petitioner's representation dated 20.03.2017, 22.03.2017 and 23.03.2017 respectively and also in compliance of the order dated 06.02.2017 in I.A.No.155/2013 in O.S.No.90 of 2013 passed by the Learned District Munsiff, Pennagaram, Dharmapuri District.

The learned counsel for the petitioner submitted that the petition filed by the petitioner under Order 39 Rules 1 and 2 was heard elaborately and a detailed order was passed on 19.09.2016, granting an order of interim injunction. Further, the District Munsif cum Judicial Magistrate, by Order dated 06.02.2017 in I.A.No.155 of 2013 directed the respondents to give adequate police protection and despite the same and also the repeated representations made by the petitioner, no action has been taken by the respondents. Hence the petitoner has filed the present petition seeking for the above relief.
3. Considering the facts and circumstances of the case, this Court is inclined to give police protection to the petitioner. Accordingly, the criminal original petition is allowed directing the respondents 3 and 4 to provide adequate police protection to the petitioner to enable him to fence his property. However, the same will be at the cost of the petitioner.
