JUDGMENT / ORDER

This is a petition filed under Article 227 of the Constitution of India taking objection to Ext.P4 order whereby, according to the petitioner, the court below fixed a low upset price for the property of the petitioner. The only prayer in this petition is that the petitioner may be allowed to pay the decree debt in instalments. 2. At the time of admission of this petition, the petitioner was directed to pay Rs.10,000/- to the respondent. The petitioner submits that he has paid the said amount and prays that he may be allowed to pay the balance decree debt in ten equal monthly instalments.
3. After having given anxious consideration to various aspects, there is no reason as to why the relief should not be granted to the petitioner.
O.P.(C) No.3187/2013 2 After adjusting Rs.10,000/- (Rupees ten thousand only) towards the decree amount, the petitioner shall pay the balance decree debt in ten equal monthly instalments, first of which shall begin from 01.01.2015 and thereafter on or before 5th of subsequent months and if there is any default in any one of the instalments, further proceedings shall be continued pursuant to Ext.P4.
This Original Petition is disposed of as above.
