Pursuant to direction issued by this Court in Writ Petition No.67582 of 2015 as well as in Contempt Petition No.3619 of 2017, the respondents have passed orders taking the institution in question on aid vide government order dated 20.10.2017. Petitioner claims to be approved teacher working in the institution, who has not been extended benefit of salary so far. In view of the government order dated 20.10.2017, salary is liable to be extended to approved teachers working in the primary section. In respect of such grievance, petitioner has approached the authorities concerned, but no decision has yet been taken. Hence, this petition.
Learned Standing Counsel as well as Sri S. K. Gupta, learned counsel for the District Basic Education Officer concerned submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's claim for being paid salary in terms of the government order dated 20.10.2017, in accordance with law, by means of a reasoned order to be passed, within a period of three months from the date of presentation of certified copy of this order.
It goes without saying that petitioner's entitlement to receive salary has not been adjudicated by this Court and all issues are left open to be examined by the authority concerned, at the first instance.
