1. State of Karnataka, Rep.by Station House Officer, Hulimavu Police Station, Bangalore-560 076.
2. K.Narayana Raju, S/o late Krishnam Raju, Aged about 52 years, No.164/4, Doresani Palya, J.P.Nagar 4th Phase, Bangalore-560 076. .. Respondents ( By Sri Sandesh J. Chouta, SPP-II for R-1 ) This Criminal Petition is filed under Section 482 Cr.P.C. praying to quash the entire proceedings in C.C.No.1152/2015, on the file of M.M.T.C.-IV, Bengaluru.
This Criminal Petition coming on for Orders this day, the Court made the following :
ORDER Heard the learned counsel for the petitioner and the learned State Public Prosecutor for the respondent No.1- Police. Perused the records.
2. Sri Vinay T.R., learned counsel for the petitioner submits that after filing of this petition, the charges are framed against the petitioner for the offences punishable under Sections 279, 337 and 304 of IPC and evidence has already been led by the prosecution. It appears two more witnesses are to be examined by the prosecution.
3. Under the above said facts and circumstances of the case, though the learned counsel has pointed out some contradictions in the evidence of the witnesses, it is for the trial Court to appreciate the same. Now on the basis of said evidence, such proceedings cannot be interfered with by this Court under Section 482 of Cr.P.C. However, the trial Court is directed to dispose of the matter as expeditiously as possible.
With these observations, Petition stands dismissed.
