Heard learned advocate for the private parties and learned APP for the respondent - State of Gujarat.
2. At the outset, Mr. Pathan learned advocate for the respondent No.2 tendered unconditional apology for the averments and pleadings made in the application filed under section 127 of the Code of Criminal Procedure, 1973 before the Family Court.
3. Learned advocate for the respondent No.2 filed an undertaking dated 14.03.2012 and submitted that as per the statement made on oath in para 2 of the above undertaking the arrears of maintenance due will be paid in 5 installments. The above undertaking is ordered to betaken on record and the respondent No.2 is directed to abide by the terms of the said undertaking.
Post the matter on 2nd April, 2012.
Ad-interim relief granted earlier to continue till further order.
