Notice on behalf of opposite party no.1 has been accepted by learned Chief Standing Counsel, whereas Mr. Tanay Hazari, Advocate has put in appearance on behalf of opposite parties no.2 and 3 and filed vakalatnama, same is taken on record. Heard learned counsel for parties and perused the records.
The instant writ petition has been filed seeking following reliefs:
"i. ISSUE a writ, order or direction in the nature of certiorari quashing the entire recovery proceeding initiated against the petitioner on the basis of Recovery/auction notice 14.1.2021 issued by the opposite party no. 2 as contained in Annexure no.1. ii. ISSUE a writ, order or direction in the nature of Mandamus commanding the opposite parties not to adopt any coercive method against the petitioner in pursuance of the auction notice dated 14.1.2021 issued by the opposite party no. 2 as contained in Annexure no. 1. iii. ISSUE a writ, order or direction in the nature of Mandamus commanding and directing the Higher authorities of the Bank to make an enquiry about the said loan in question without mortgaging property of borrower. iv. Any other order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case may kindly be passed in favour of the petitioner and against the opposite parties. v. Allow the writ petition with cost."
The perusal of impugned order does not indicate that it is a recovery notice.
Learned counsel for the petitioner at this stage makes a statement at the bar that he may be permitted to not press this writ petition. The writ petition is accordingly dismissed as not pressed.
