Controversy raised in the present writ petition has already been adjudicated by a Division Bench of this Court in Sunita Sharma vs. State of U.P. and others; 2015(3) ESC 1289.
Learned Standing Counsel and Sri A.C. Srivastava, Advocate appearing for the respondents do not dispute the legal proposition settled in the matter.
In view of the law already settled, the authorities of the State would not be justified in allocating election work to the petitioners, who are specifically engaged for imparting education.
In view of the law already settled by this Court, the writ petition is disposed of with a direction upon the authorities to act strictly in accordance with law laid down in the case of Sunita Sharma (supra) so that persons, such as petitioners, are not engaged in other activities which have the effect of denying education to the students.
