Heard learned counsel for the applicant and learned AGA for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the order dated 15.06.2018 passed by the learned Additional District and Sessions Judge, Court No. 5, Kanpur Dehat thereby allowing the application paper no. 29-Ka under Sections 319 Cr.P.C. of the informant/opposite party no. 2 thereby summoning the applicant under Section 323, 504, 336 and 304 IPC in S.T. No. 282 of 2016, case crime no. 192 of 2016, State Vs. Jagdish and other, P.S. Rasoolabad, District- Kanpur Dehat.
I have perused the impugned order and the evidence on the basis of which the applicant has been summoned under Section 319 Cr.P.C.
Prayer for quashing the impugned order is refused, which is based upon relevant consideration and supported by cogent reasons.
Considering the facts and circumstances of the case and without making any comment upon the validity of the impugned order, this application is finally disposed of with a direction that if the applicant appears and surrenders before the Court below within 30 days from today and apply for bail, then his bail application shall be considered and decided expeditiously in accordance with law.
