This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Kuldeep Kumar, in the event of his arrest in Case Crime No.338 of 2019, under Section 498-A, 304-B I.P.C. and Section 3/4 D.P. Act, Police Station Kurawali, District Mainpuri.
Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
The perusal of the record shows that it is a case under Section 498-A, 304-B I.P.C. and 3/4 D.P. Act. There are allegations about the demand of dowry and cruelty having been inflicted upon the deceased because of its non fulfilment. She was beaten up often in that regard and had to be brought back to her parental house in a mentally broken condition. Even thereafter the husband repeatedly used to call her and give threats and pressed for demand of dowry. The nature of cruelty inflicted upon her was such which allegedly had driven her to consume poison as a result of which she eventually died.
After considering the submissions advanced on behalf of rival sides, the nature and gravity of the accusation and the material in support of the same, I find no good ground for grant of anticipatory bail to the applicant.
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
