Petitioner's father was employed in the respondent U.P.S.R.T.C. and died on 30.10.2018 in harness. The application to grant compassionate appointment has remained pending and hence this petition.
Learned counsel for the U.P.S.R.T.C. points out that the petitioner's elder brother had filed an objection against the claim of the petitioner.
Be that as it may, once an application for compassionate appointment has been filed before the competent authority, a decision is required to be taken after considering the objection raised by other claimant. Competent authority is also required to issue notice to other family members before taking a final decision.
In that view of the matter, this writ petition is disposed of with a direction upon the respondent no. 3 to take a final decision on the claim of the petitioner, after due opportunity to the parties, in terms of the above observation within a period of three months from the date of presentation of a certified copy of this order.
