Heard Mr. Arun Kumar Tiwari, learned counsel for the applicant and the learned A.G.A. for the State.
Learned counsel for the applicant submits that certain sections of I.P.C. have been mentioned in prayer clause of the application, which is due to inadvertent typographical error. He, therefore, submits that permission me granted to correct the same.
Prayer made for is bonafide. Accordingly, the same is allowed.
Let necessary corrections be made in the prayer clause of the present application.
This application under Section 482 Cr.P.C. has been filed for a direction to the Judicial Magistrate, Kanpur Dehat to decide the complaint Case No. 701 of 2017 (Kuldeep Vs. Awadesh Kumar), registered on 10.2.2017.
Learned counsel for the applicant submits that the statement of the complainant and of his witnesses required to be recorded under Sections 200 and 202 Cr.P.C., has not been recorded till date, even though a period of one year and six months have rolled by.
Considering the aforesaid facts, it is hereby provided that the Court concerned shall conduct an inquiry in terms of Sections 200 and 202 Cr.P.C., within a period of two months from the date of production of certified copy of this order.
With the aforesaid direction, this application is finally disposed of.
