Kubendran vs Vimala

Madras High Court|28 June, 2017

JUDGMENT / ORDER

This Criminal Revision Case is filed by the husband against the order dated 27.08.2014, passed in M.C.No.37 of 2010 on the file of the Judicial Magistrate No.1, Thanjavur, in and by which, the Magistrate has granted maintenance at the rate of Rs.5,000/- (Rupees Five Thousand only) for the wife and Rs.3,000/- (Rupees Three Thousand only) for the minor daughter.
2. Despite his best efforts, Mr.M.V.Venkataseshan, learned Counsel for the petitioner/husband is unable to show that the maintenance awarded is on the higher side. The petitioner/husband is an Engineering Contractor and he also owns a car. The extensive nature of his business is proved by the fact that he has printed monthly calender in his name. This Court is of the view that the petitioner/husband has got good monthly income and the maintenance of Rs.8,000/- (Rupees Eight Thousand only) awarded by the trial Court is just and reasonable.
3. Though the petitioner/husband had claimed that the first respondent/wife is qualified B.Sc., B.Ed., and she is employed in a private school in Mannarkudi, the same has not been proved by any acceptable evidence.
4. Therefore, I do not find any reason to interfere with the finding of the trial Court on the quantum of maintenance.
5. Accordingly, this Criminal Revision Case is dismissed, confirming the order dated 27.08.2014, passed in M.C.No.37 of 2010 on the file of the Judicial Magistrate No.1, Thanjavur. Consequently, the connected miscellaneous petition is also dismissed.
To The Judicial Magistrate No.1, Thanjavur..
