A.M.Shaffique, J. Petitioner has approached this Court complaining about the illegal activities by the respondents 7 to 9 and their men. Petitioner had already filed a case as OS No.942 of 2008 for declaration of title and for mandatory injunction, directing the defendants in the said suit to give vacant possession of the property. The suit has been decreed and the appeal filed by the defendants had been dismissed and the petitioner got possession of the property on 11.04.2012. The complaint of the petitioner is that, thereafter the respondents 7 to 9 were trying to trespass into the property and cause harm to the petitioner and his family members. Though a complaint Ext.P3 was filed, police did not take any action and hence the petitioner had approached this Court seeking police -2-
W.P.(C). No.10430 of 2012 protection.
2. By an interim order dated 04.05.2012, this Court directed the respondents 4 and 5 to afford adequate and effective police protection to the life of the petitioner and his family members.
3. The learned counsel for the petitioner submits that thereafter there had not been any issue regarding threat from the party respondents.
4. Having regard to the aforesaid factual situation, we do not find any necessity to issue any further direction as sought for in the writ petition. However we make the interim order absolute.
The Writ Petition is closed accordingly.
