JUDGMENT / ORDER

Thottathil B. Radhakrishnan, J.
Heard the learned counsel for the petitioner.
2. A rent control appeal filed by the petitioner was dismissed for default. He filed application for restoration of that appeal. The Appellate Authority restored that appeal on terms. That order was issued on 02/07/2014. The petitioner did not pay the costs imposed as per that order. As a result, the restoration will stand vacated. Obviously therefore, if the petitioner satisfies the Appellate Authority that he had cause for not satisfying the order passed by the Appellate Authority and that he has sufficient cause for further readmission of the appeal dismissed for default, it is up to him to seek such relief before the Appellate Authority which may consider such request, in its wisdom, untramelled by O. P. (RC) No.126 of 2014 -2-
anything stated herein, even on stringent terms. The fact situation in hand does not pave way to entertain this original petition under Article 227 of the Constitution of India. Hence, without expressing anything on merits regarding the eligibility for readmission of the appeal before the Appellate Authority and without prejudice to any such remedies before the Appellate Authority, this original petition is dismissed.
