Petitioner has approached this Court seeking for a declaration that the proposed project covered by Exts.P1 to P3 is illegal in the light of the clauses in Appendix 1 and 2 of Ext.P5.
2. The allegations in the writ petition disclose that respondents are misutilising the fund allocated as per the Legislative Assembly Constituency Asset Development Fund at the instance of 6th respondent who is a Member of Legislative Assembly. It is inter alia contended that amounts have been spent for religious adoration which is against the principles and guidelines as per Appendix 1 and 2 in Ext.P5. The petitioner submits that he has already given Ext.P6 complaint to the respondents, but no action has been taken in the matter.
3. Even according to the petitioner, it is a fund which is to be utilised by the Member of Legislative Assembly and funds have been allocated according to the nature of activities.

The issue of utilisation of funds by Member of Legislative Assembly after getting necessary permission cannot be considered in a public interest litigation. If the petitioner has any grievance in the allocation of funds, his remedy is to approach the competent authorities. We do not think that this Court should sit in judgment to consider utilisation of MLA fund in a Public Interest Litigation. This Writ Petition is dismissed.
