The above appeal pertained to the year 2006 was filed challenging the order dated 05.11.2004 in O.P.No.226 of 2003 of the Family Court, Kozhikode, by which the Family Court declared the absolute and exclusive title of the petitioner therein to have exclusive guardianship, custody and care of the minor children, against the 3rd respondent therein, who is the present appellant. Learned counsel appearing for the appellant has filed a memo dated 11.06.2014 wherein it is stated that the files were taken by the party/appellant in 2007 and she has no instruction in the above case and requested this Court to record the above fact. The said facts and the memo are recorded. The above memo discloses that the counsel appearing for the appellant has no instruction and, therefore, she is not in a position to proceed with the hearing of the appeal. No representation for the respondent as well.
Mat.Appeal No.201/2006 2 In the above circumstances, the above appeal is dismissed for non-prosecution.
