Petitioner has submitted Ext.P3 complaint before the 1st respondent under the Kerala (Scheduled Castes and Scheduled Tribes) Regulation of Issue of Community Certificates Act, 1996 (Act 1 of 1996) (hereinafter referred to as ‘the Act’).
2. The complaint of the petitioner is that the 3rd respondent has obtained employment stating that he belongs to Scheduled Caste “Kurava” community overlooking the seniority of the petitioner. According to the petitioner, 3rd respondent is not entitled for the said reservation as he does not belong to a scheduled caste community and therefore necessary enquiry has to be conducted in terms of Section 11 of the Act.
Having regard to the aforesaid submission of the petitioner, I am of the view that since Ext.P3 is an W.P.C.No.13963/2014 2 application under Section 11 of the Act, this writ petition can be disposed of as under without notice to the 3rd respondent:
The 1st respondent shall conduct necessary enquiry with reference to Ext.P3 and pass appropriate orders after hearing the affected parties within a period of six months from the date of receipt of a copy of this judgment.
