JUDGMENT / ORDER

The Civil Revision Petition is filed by the plaintiff praying to direct the learned IV Assistant Judge, City Civil Court, Chennai to take up the I.A.No.7179 of 2009 in O.S.No.3833 of 2009 and dispose of the same in accordance with law.
2. Plaintiff, the revision petitioner filed the suit for permanent injunction restraining the defendant, the respondent herein from interfering with the plaintiff's peaceful possession and enjoyment of the suit Schedule A and B properties.
3. Along with the plaint, plaintiff also filed I.A.No.7179 of 2009 praying interim injunction restraining the defendant, the respondent herein from interfering with the plaintiff's peaceful possession and enjoyment of the suit Schedule A and B properties. In that I.A., counter was filed on 21.5.2009. After hearing arguments on three occasions, viz., on 1.7.2009 and 10.7.2009 and 22.7.2009, the case was posted for delivering orders on 7.8.2009. Thereafter, the matter was once again adjourned to 27.8.2009 as orders not ready. On 27.8.2009 case was reopened for clarification. Then, it was posted to 7.9.2009. Now it was posted to 9.10.2009 for fresh arguments.
4. The grievance of the revision petitioner/plaintiff is to direct the trial court to dispose of the I.A.No.7179 of 2009 at an early date.
5. On perusing the certified copy of petition and orders thereon filed along with the memorandum of grounds there seems to be no good reason as to why the I.A.No7179 of2009 has not been disposed of at an early date. However, it would suffice if the trial court is directed to dispose of the I.A.No.7179 of 2009 as expeditiously as possible without granting unnecessary adjournments.
6. In the result, the Civil Revision Petition is allowed. The IV Assistant Judge, City Civil Court is directed to take up the I.A.No.7179 of 2009 and dispose of the same as expeditiously as possible preferably on or before 31.10.2009 if it is not disposed off already. Consequently connected miscellaneous petition is closed.
