The prayer in the writ petition is for a writ of Certiorarified Mandamus to call for the records on the file of the first respondent pursuant to the impugned order of relieving/diversion passed by him in his order vide proceedings R.No.3183/A1/2010 dated 17.05.2010 and quash the same. Subsequently, the prayer got amended, which reads as follows:
?Writ of Certioararified Mandamus to call for the records on the file of 1st respondent in pursuant to the impugned order of relieving / diversion passed by him in his order vide R.No.3183/A1/2010 dated 17.05.2010 and the impugned order passed by the 4th respondent vide his proceedings in Ref.No.2652/SHS/P3/10 dated 06.05.2010 and quash the same as illegal in so far as the petitioner is concerned and consequently direct the 1st and 2nd respondents to accommodate the petitioner in the office of Deputy Director of Health Services, Thoothukudi within the time limit that may be stipulated by this Court?.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 and 2.
3. The learned counsel for the petitioner submits that during the pendency of the writ petition, the very services of the petitioner itself has been dispensed with by the respondent on 03.11.2010. As against which, the petitioner filed writ petition, unsuccessfully, and therefore, filed an intra Court writ appeal before this Court, which is also pending. Be that as it may, since the very services of the petitioner itself has been dispensed with, the present impugned order, whereby the petitioner earlier was transferred or diverted from one place to another place, since has been questioned the same, cannot be adjudicated at this juncture. As no further order need to be passed in this writ petition, as the issue agitated herein, since having become infructuous, this Writ petition is disposed of without any further orders. No costs.
