2.It is now found that A.S.No.386 of 1994 has been dismissed by this Court on 25.07.2008 on merits. The respondents have not been served.
3.Mr.R.Aravind, who is appearing for the appellant, would submit that he has not entered appearance in the transferred appeal and his name is shown as counsel for the appellant, since he has filed the transfer application in this Court. However, no steps have been taken for service of notice on the respondents. Therefore, the Appeal Suit is dismissed for default. There shall be no order as to costs.
