JUDGMENT / ORDER

This criminal original petition has been filed under Section 482 of Cr.P.C., praying to call for the records in C.C.No.214 of 2004 on the file of the Judicial Magistrate, Paramakudi and quash the same.
2.It is submitted by the learned Additional Public Prosecutor that P.W.1 has been examined in this case and for examination of further witnesses, the case is posted to 23.01.2017. Under the said circumstances, this criminal original petition may be dismissed.
3.The learned counsel for the petitioner also concedes that the trial has begun and he requests that he may be permitted to advance all his defences including the grounds taken in this criminal original petition before the trial Court.
4.Considering the fact that the trial has already begun and one witness has been examined, this criminal original petition is dismissed. However, the petitioner is at liberty to put forth all his defences including the grounds taken in this criminal original petition before the trial Court. Consequently, connected miscellaneous petitions are also dismissed. The trial Court is directed to dispose of C.C.No.214 of 2004, within period of three months from the date of receipt of a copy of this order and report to this Registry.
