The petitioner filed this petition to direct the respondents to grant ten days emergency leave to her son, Somu @ Somasundaram, who was now confined at Trichy Central Prison, convicted by the learned III-Additional PCR Court, Madurai, by judgment dated 31.07.2009, in S.C.No.631 of 2001, for the purpose of attending the funeral ceremonies of her deceased younger son, Manikandan.
2. Heard Ms.P.Krishnaveni, learned counsel appearing for the petitioner and Mr.K.Anbarasan, learned Government Advocate (Crl. Side) appearing for the respondents.
3. The learned Government Advocate (Crl. Side) on instructions, would submit that the petitioner is entitled for three days of ordinary leave and therefore, the request of the petitioner seeking emergency leave for ten days cannot be considered.
4. Considering the fact that the petitioner is not entitled to ten days of emergency leave, this Court is inclined to issue the following direction to the respondents:
?The respondents are directed to grant ordinary leave of three days to the petitioner's son, by name Somu @ Somasundaram, son of Krishnan, now convicted at Trichy Central Prison, only for attending the funeral ceremony of the petitioner's younger son, by name Manikandan, subject to other conditions, forthwith.?
5. This petition is ordered accordingly.
