K.Shanmugaiah vs The District Revenue Officer

Madras High Court|17 February, 2017

JUDGMENT / ORDER

This Writ Petition has been filed seeking for issuance of a Writ of Mandamus directing the 1st respondent to cancel the UDR patta stands in the name of the 3rd and 4th respondents herein and issue patta in the petitioner's name with regard to the lands in Survey Nos.314/1 and 318/2, measuring an extent of 3 Acre 98 cents, situated at South Ilanthaikulam Village, Kovilpatti Taluk, Thoothukudi Village, on the basis of the petitioner's representation, dated 27.01.2017.
2.Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for the respondents 1 and 2.
3.By consent of both parties, the main Writ Petition itself is taken up for final disposal at the admission stage itself.
4.The case of the Petitioner is that the lands in South Illanthaikulam Village, comprised in S.Nos.314/1 and 318/2, originally stood in the name of Sudalai Madakudumpan and Valakudumpan. After the demise of the said persons, the legal heirs of Valakudumpan sold their shares to the respondents 3 and 4, however, the legal heirs of Sudalai Madakudumpan had not sold their shares. The Petitioner submits that the property has now been changed in the name of the respondents 3 and 4, without notice to the Petitioner and other legal heirs of Sudalai Madakudumpan. Hence, in order to have corrections carried out in UDR, the Petitioner had given a representation, dated 27.1.2017 to the first respondent and since the same has not been considered so far, the present Writ Petition has been filed before this Court.
5.In view of the limited scope of the prayer sought for in this writ petition and without going into the merits of the claim made by the Petitioner, there shall be a direction to the first respondent to consider the petitioner's representation, dated 27.1.2017 on its own merits, after conducting due enquiry and by giving prior notice to the persons interested in the subject lands and pass orders on the same in accordance with law, as expeditiously as possible.
6.With the above direction, this Writ Petition stands disposed of. No costs.
To
1.The District Revenue Officer, Thoothukudi District, Thoothukudi.
2.The Tahsildar, Kovilpatti Taluk, Kovilpatti, Thoothukudi District.
