The present writ petition has been preferred beyond time by 1027 days as per stamp report dated 24.6.2021.
Heard learned counsel for the petitioners and the learned AGA.
This writ petition has been filed praying for the following reliefs:-
(i) Issue a writ, order or direction in the nature of certiorari to quashed the impugned First Information Report dated 03.06.2018 arising out of Case Crime No. 677 of 2018 under Sections 498A, 323, 307, 308 I.P.C. & 3/4 of D.P. Act, Police Station- Kotwali Dehat, District- Bulandshahr.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 2 not to arrest the petitioners in pursuance of the Information Report dated 03.06.2018 arising out of Case Crime No. 677 of 2018 under Sections 498A, 323, 307, 308 I.P.C. & 3/4 of D.P. Act, Police Station- Kotwali Dehat, District- Bulandshahr.
After the arguments were heard at some length, learned counsel for the petitioners states that the petitioners want to withdraw the present writ petition with liberty to apply for anticipatory bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioners.
In view of the aforesaid, the writ petition is disposed of with liberty to the petitioners to apply for anticipatory bail/bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on the merits of the case of the petitioners.
