While so, respondent No.3 died and persons claiming to be his legatees have filed a separate miscellaneous petition, being W.P.M.P. No.42076 of 2014, seeking refund of the amount allegedly deposited by respondent No.3.
In the light of the death of respondent No.3 and as the leasehold rights were granted to him for a time bound period, the writ petition itself has become infructuous and it is accordingly dismissed as such. It shall be open to the petitioners in W.P.M.P. No.42076 of 2014 to work out their remedies separately in accordance with law and the miscellaneous petition stands disposed of accordingly. Other pending miscellaneous petitions, if any, shall stand closed in the light of this order. No order as to costs.
