Heard Sri Ajay Kumar, learned counsel for the petitioner, Sri N.K. Tiwari, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 18.72013 registered as case crime no. 290 of 2013 under sections 409, 420, 120-B I.P.C. and 13 (1) D read with 13 (2) Anti Corruption Act, 1988, police station Kotwali Dehat, District Etah.
Learned counsel for the petitioner submits that on similar allegations several F.I.Rs. have been registered against nine hospitals and one of the F.I.R. on similar allegation has been challenged before this Court in Crl. Misc. Writ Petition No. 2556 of 2018 in which co-ordinate Bench of this Court has granted interim protection to the petitioners in the said petition, hence the petitioner also entitled for the same relief.
Copy of the aforesaid order has been produced by learned counsel for the petitioner which is taken on record.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
The Investigating Officer of the present case is directed to conclude the investigation of the present case and submit the police report before the court concerned expeditiously preferably within a period of three weeks from the date of production of a certified copy of this order.
With the above direction this petition is finally disposed of.
