This Criminal Original Petition is filed to issue a direction to the respondent police not to harass the petitioner in connection with the complaint launched by the de facto complainant by name Kasthuri.
2. It is stated by the petitioner that in the year 2007, the de facto complainant purchased a landed property from one Purushothaman who is the power of attorney of one Prabudass. The said Prabudass is working in Avadi Tank Factory. After purchase of the property, the same was taken by the Government for widening the road for National Highways Project. For this transaction, the petitioner acted as a land broker. But it is stated in the complaint filed by the de facto complainant that she purchased the property only from the petitioner.
3. The learned counsel for the petitioner submits that the petitioner is only a land broker and he has no legal knowledge and he did not know about the land acquisition. While so, the respondent police, under the guise of enquiry, harassing the petitioner by frequently calling him to the Police Station.
4. On the other hand, the learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner failed to appear before the respondent police for early disposal of the complaint.
5. Heard the learned counsel on either side.
6. To give a quietus to the issue, the petitioner is directed to appear before the respondent police on 30.01.2017 and 31.01.2017, for enquiry. On such appearance, the respondent police shall enquire the petitioner and dispose of the complaint in accordance with law.
7. The Criminal Original Petition is disposed of accordingly.
