Respondents These Writ Petitions are filed under Articles 226 & 227 of the Constitution of India praying to direct respondent No.3 to accept the examination fees of the petitioners and to permit the petitioners for appearance in examination which will be held from 22nd February 2019, vide Annexure-A dated 20.12.2018.
These Writ Petitions coming on for Preliminary Hearing, this day, the Court made the following:-
O R D E R Smt. Saraswathi, learned counsel for the petitioners and Smt. Pramodhini Kishan, learned AGA for respondents graciously agrees that the subject matter of these writ petitions is substantially similar to the Writ Petition Nos.342- 346/2019 (Education Examination) disposed off by this Court vide judgment dated 03.01.2019, a copy whereof at Annexure-B.
2. Learned counsel for the petitioners pressing into service the principle of parity submits that the petitioners herein also need to be granted same relief as has been granted in the aforesaid writ petitions.
3. There is no impediment for granting such relief to the petitioners who are apparently similarly circumstanced.
4. In the aforesaid order, this Court in the last paragraph has granted the relief to the litigants therein as under:-
“In the above circumstances, these writ petitions succeed in part; a Writ of Mandamus issues to the third and fourth respondents to accept the examination fees, if tendered by the petitioners on or before 17.01.2019 and to permit them to write the ensuring respective examinations if they are otherwise eligible.”
4. In the above circumstances, these writ petitions also succeed in part; a Writ of Mandamus issues to respondent Nos.3 and 4 to accept the examination fees, if tendered by the petitioners on or before 23.02.2019, if they are otherwise eligible.
