An application under Section 156(3) Cr.P.C. is pending since 09.05.2019. A perusal of the ordersheet shows that proceedings are being casually adjourned. The petitioner seeks a direction to the Magistrate to expedite proceedings and conclude the same within some a determinate period of time.
It is needless to say that an application under Section 156(3) Cr.P.C. is an important matter and does not involve much proceedings which may consume judicial time of the Magistrate.
Looking to the nature of the order proposed to be made, notice to opposite party nos. 2 to 6 is dispensed with.
It is made clear that anything said in this order will not be construed as an expression of opinion on merits and the Magistrate is free to pass order in accordance with law.
In the circumstances, it is directed that the Magistrate shall proceed to decide Case No. 198 of 2019, Smt. Krishna vs. Brijendra Kumar Shah and others, under Section 156(3) Cr.P.C. within a month of receipt of a computer generated copy of this order downloaded from official website of the Allahabad High Court.
This application is disposed of, in view of the above orders.
