By means of this writ petition the petitioner has challenged the recovery certificate issued in 2006. This recovery is with regard to the transit fee for transportation of minerals through the forest area.
Learned counsel for the petitioner submits that the petitioner was not aware of this recovery citation as the same was never served upon the petitioner. Now the citation is being pressed.
First of all we are not inclined to interfere in the citation which was issued in 2006. That apart the authorities cannot proceed for recovery in 2019 pursuant to citation issued in 2006. However, if any amount is outstanding against the petitioner, it is open for the authorities to pass fresh orders and proceed against the petitioner in accordance with law.
With the aforesaid observation/direction, the writ petition is disposed of.
