JUDGMENT / ORDER

Petition under Section 438 Cr.P.C. 2. Petitioners are accused Nos.1 and 2 in Crime No.241/2014 of Malayinkeezhu Police Station, registered for the offences punishable under Sections 394 of the Indian Penal Code.
3. The allegation against the petitioner and other accused, is that on 29.3.2014 at 10 p.m. they attacked the de-facto complainant, who was walking through the road and forcibly took away an amount ₹550/- from his pocket. Accused Nos.3 and 4 have been arrested and they have been enlarged on bail.
4. Heard the learned counsel for the petitioners and the learned Public Prosecutor. The allegations against the petitioners are very serious. The prosecution records primafacie reveal the B.A.No.6970 of 2014 2 complicity of the petitioners. Earlier the petitioners have moved this Court for anticipatory bail through B.A. No.3732 of 2014, and the same was dismissed through a well considered order dated 5.6.2014. The present petition is nothing, but an abuse of the process of this Court, and this petition cannot be entertained.
5. It has been reported that the first accused is involved in 2 other crimes and the second accused is involved in another crime also. Considering the seriousness of allegations against the petitioners, I am of the view that the petitioners are not entitled to the discretionary relief of anticipatory bail.
In the result, this Bail Application is dismissed.
