Petitioners are accused 1 to 3 in Crime No.241 of 2014 of the Malayinkeezhu Police Station for the offence punishable under Section 394 of the Indian Penal Code, apprehend arrest and have filed the application.
2. Learned Public Prosecutor has opposed the application. It is submitted that on 29.03.2014 at about 10.00 p.m., the petitioners and the 4th accused attacked the de facto complainant and forcibly took Rs.550/- from his pocket. Petitioners 1 and 2 are involved in Crime Nos. 854 of 2013 and 683 of 2013 respectively for the offence under Section 279 of the IPC. The 4th accused is arrested and released on bail.
3. Learned counsel submitted that the allegations are not true and it is politically motivated.
4. Having regard to the nature of allegations made against the petitioners and the investigation required to be done request for pre-arrest bail cannot be allowed.
It is directed that in case the petitioners are arrested, B.A.No.3732 of 2014 2 they shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of with the above direction.
