Ms. Ghazala Bano Quadri, learned counsel for the petitioner and Sri Girish Vishwakarma, learned Standing Counsel for respondent.
Counsel for the petitioner submits that petitioner, who is a farmer, had obtained an agricultural loan in the year 2015 but he could not deposit the loan amount due to loss in his agriculture and now the office of the Tehsildar, Tahsil Baraut, District Baghpat has issued a recovery citation to recover the remaining loan amount of Rs. 4,54,678/-. He submits that petitioner is willing to pay amount in easy installments to be fixed by this court.
Taking the facts of the case into consideration and fair submission made by the counsel for the petitioner, it is directed that petitioner shall deposit a sum of Rupees 2,54,678/- on or before 31.1.2021 and remaining Rs. 1,00,000/- (Rs. One Lakh) in two equal installments on 28.2.2021 and 31.3.2021. Last installment shall include any residual interest or cost besides principal amount. In case petitioner deposits such amount then aforesaid recovery citation issued by the Tehsildar shall be kept in abeyance till 31.3.2021.However, in case of default of payment of first installment on time the authorities will be free to go ahead with their recovery citation.
In above terms, the writ petition is disposed of.
