Heard learned counsel for the applicant, Sri Manish Tiwari, learned counsel on behalf opposite party nos.2,3 and 4 and the learned AGA for the State- respondent.
The present transfer application has been filed for transferring the bail application no.2498 of 2009, pending in the Court of Sessions Judge, Varanasi, in case crime no.672 of 2009, under Sections 302, 307, 120-B IPC, from District Varanasi to any other adjoining district. It is contended by the learned counsel for the applicant that opposite party no.2 and 4 are Advocates practising at Varanasi and on account of their pressure, the bail application would be allowed and justice will not be done in the case. It is further contended that the bail application may be transferred to any other adjoining district. Sri Manish Tiwari, learned counsel for the opposite party no.2 to 4 states that he has no objection if the bail application is transferred to some other adjoining district.
Considering the facts and circumstances of the case and submissions made by learned counsel for the parties, the bail application No. 2498 of 2009, pending in the Court of Sessions Judge, Varanasi, in case crime no.672 of 2009, under Sections 302, 307, 120-B IPC, is transferred to the Court of competent jurisdiction at district Mirzapur. It is expected that the Court at Mirzapur will consider and decide the pending bail application, which is to be transferred, as expeditiously as possible, in accordance with law, after hearing the parties.
