Heard Sri A.C. TIwari, learned counsel for the petitioner, Sri A.K. Sand, learned AGA for the State and perused the record.
The prayer made in the present petition is for directing the S.S.P, Ghaziabad to transfer the investigation of case crime no.716 of 2018, P.S. Kavi Nagar, u/s 419, 420, 467, 507 and 66-D I.T. Act, dated 26.4.2018 to any other police agency/wing from civil police of police sation Kavi Nagar, Ghaziabad for its fair investigation.
It has been argued by learned counsel for the petitioner that the petitioner is the accused in the present case and he had earlier filed writ petition for fair investigation which was disposed of by coordinate Bench of this Court on 27.11.2018 but the said order has not yet been complied with.
Learned AGA has raised a preliminary objection regarding maintainability of the present writ petition as the same is not maintainable for the same cause of action.
Considering the submissions made by learned counsel for the parties we are not inclined to interfere in the matter, The writ petition is, accordingly, dismissed.
