1. Learned counsel for the petitioner submits that he will approach the Assistant Collector/S.D.M., competent authority under Section 67 of the U.P. Revenue Code, 2006 for removal of encroachment by private respondents over the land in Gata No.2183 measuring area 0.012 htr, situated at Village Paraspur Pure Baldev Pandit, Tehsil Colonelganj, District Gonda which is recorded as pond in the revenue record.
2. Learned counsel for the petitioner submits that he will file an appropriate petition as provided under the law before the competent authority within a period of ten days along with order passed by this Court today.
3. If such an application is moved under the provisions of U.P. Revenue Code, 2006 or any other relevant provision along with this order, the competent authority is directed to decide the case in accordance with law expeditiously preferably within a period of six months and take effective steps for removal of encroachment over the public utility land of the Gaon Sabha by private respondents and any other person(s), if they have been found to be encroachers upon the land in question.
The competent authority may take help of the police as provided under Section 67(3) of the U.P. Revenue Code, 2006 for removal of encroachment, if it is found that private respondents or any other person(s) have encroached upon the Gaon Sabha land.
4. In view of the aforesaid, direction/observation, the petition is disposed of.
