Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that applicant has been challaned under the Gangster Act along with other co- accused. Eight cases were shown against the applicant in Gang chart. Those cases were of petty offences and in all those cases applicant has already been released on bail. Against co-accused only one case was shown hence it appears there was no gang and applicant and other co-accused were not member of any gang, hence case of the applicant is not covered under the Gans Act. However, in the present case, applicant is in jail since 18.4.2010.
Considering the aforesaid facts, without observation on merit it is a fit case for bail. Let the applicant namely, Krishan Kumar Singh @ Naga Singh be released on bail in Case Crime No. 228 of 2010, under section 3(1) of U.P. Gangster and Anti Social Activities (Prevention) Act, P.S. Baresar, District Ghazipur on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned with the following condition;
The applicant will report to the police station concerned by 10th of each month to show his good conduct and behavior and he will cooperate with the trial.
In case of breach of the aforementioned condition, the Court below shall be at liberty to cancel the bail.
