Heard learned counsel for the petitioner and the learned standing counsel.
Learned counsel for petitioner submitted that the order of this court dated 17.8.2009 was not complied with by the opposite parties.Name of the petitioner was in the select list and the court had directed to consider the appointment of the petitioner and also to consider the relaxation in age.
Learned counsel for opposite party has submitted that the matter of the petitioner was considered and he was not found eligible for appointment, therefore, the order stands complied with.
Learned counsel for petitioner submitted that from the said select list three other persons,as mentioned in annexure-5 to the petition, were given services but in spite of the specific direction of the court, the name of the petitioner was not considered for appointment.
Learned counsel for opposite party No.3 submits that now the District Magistrate has been changed and he be given time to take fresh decision in the case of the petitioner in the light of the directions of this court. On his request, two weeks time is granted to the counsel for opposite party No. 3.Within this time, opposite party No. 3 shall take decision afresh in the matter of the petitioner and shall file counter affidavit as to what decision has been taken.
List after two weeks.
