Heard learned counsel for the parties.
Petitioners are before this Court assailing the validity of order dated 12.12.2017 passed by Additional Commissioner Ist Allahabad in Appeal no.20150200001664 of 2015 (Usha Shukla and another vs. State of U.P. and others).
At the very outset, Shri Rajesh Srivastava, learned Standing Counsel raised an objection that in view of the provision contained under Second Schedule Item no.16, the petitioner has got alternative remedy to file second appeal before the Board of Revenue and as such, no interference is required in the matter.
Once such an objection has been made, then this Court has proceeded to peruse the record in question and finds that the order impugned has been passed in Appeal no.20150200001664 of 2015 and against the same, the petitioner has got efficacious alternative remedy to file second appeal under II Schedule, item no.16 of U.P.Z.A.&L.R. Act, 1950 and as such, no interference is required in the matter. However, in case any such appeal is preferred by the petitioner within three weeks' period, this Court hopes and trust that the Appeallate Court would proceed to decide the stay application expeditiously.
With these, Writ Petition is disposed of.
