JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 18765 of 2004 Petitioner :- Krishna Kant Dubey Respondent :- State Of U.P. And Others Counsel for Petitioner :- Vinod Kumar Singh,Ashok Khare,S.N. Yadav Counsel for Respondent :- C.S.C.,D.K. Singh Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs for issuance of :
"(i) A writ, order or direction in the nature of certiorari quashing the order date 6.2.2004 passed by the Regional Assistant Director of Education (Basic) IV Region, Allahabad (Annexure 18 to the writ petition).
(ii) A writ, order or direction in the nature of certiorari quashing the order dated 20.6.2000 passed by the Regional Assistant Director of Education (Basic) IV Region, Allahabad in so far as it sanctioned salary to the junior most from amongst the respondent nos.6 and 7 as Assistant Teacher (Annexure 11 to the writ petition).
(iii) A writ, order or direction of suitable nature commanding the respondents to make regular payment of monthly salary to the petitioner regularly every month as Assistant Teacher of Pt. Rampyare Tiwari Junior High School, Bhagwara Vivipur, Allahabad from government grant under the provisions of U. P. Junior High School (Payment of Salary to Teachers and other Employees) Act, 1978.
(iv) A writ, order or direction of suitable nature commanding the respondents to disburse to the petitioner the arrears of his salary as Assistant Teacher from 1.12.1998 till date from government grant within a period to be specified by this Hon'ble Court.
(v) Any other writ, order or direction as the petitioner be entitled in law.
(vi) Costs may be awarded in favour of the petitioner."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
