Petitioner's father was a Class IV employee in the respondent no. 3 Institution. He has died in harness on 1.10.2020. Compassionate appointment on Class III post was issued to petitioner, but one of his certificate has been found forged. Petitioner therefore has made an application for being considered for appointment to a Class IV post. Since such claim has not been considered the petitioner is before this Court.
Sri Namit Srivastava for the Committee of Management states that petitioner has secured appointment on the basis of fraudulent documents and the management was being pressurized to allow the petitioner to join on Class III post.
Be that as it may, it is admitted that petitioner's father was employed in the institution and in terms of applicable provisions petitioner's claim for compassionate appointment is liable to be considered after his father has died in harness.
In the event petitioner does not possesses qualification for Class III post, his claim shall be considered for appointment to a Class IV post by the competent authority within a period of three months. Opportunity of hearing would be given to the committee of management by the Inspector before passing such order.
With the above directions, this writ petition stands disposed of.
