Sri Ashish Somvanshi, learned counsel for the petitioner and Sri Narendra Deo Upadhayay, learned counsel for respondent no. 2.
After arguing for some time, Sri Ashish Somvanshi is in agreement that the impugned order dated 19.3.2021, being only a remand order, if a direction is given to the concerned Sub- Divisional Magistrate, Mohammadabad, Ghazipur, to decide the case upon remand as expeditiously as possible and within a period of thirty days from the date of production of a copy of this order, he shall be satisfied and shall not pray for any other relief.
This prayer is not opposed by learned A.G.A.
In view of such facts, this writ petition can be disposed of with a direction to Sub-Divisional Magistrate, Mohammadabad, Ghazipur, to decide the aforesaid case upon remand as expeditiously as possible, preferably, within a period of thirty days from the date of receipt of computer downloaded copy in PDF form of this order, strictly in accordance with law.
In above terms, the writ petition is disposed of.
It is made clear that this Court has not expressed any opinion on merits of the case.
