Heard learned counsel for the petitioner and Sri B.P. Singh, learned Standing Counsel appearing for respondents no. 1, 2, 3 and 4 and Sri Manoj Kumar Yadav, learned Standing Counsel appearing for respondent no.5 and Sri Anil Kumar Tiwari, learned Standing Counsel appearing for respondent no.6 and perused the record.
Present petition has been filed with following prayers:
"Issue a writ, order or direction in the nature of mandamus commanding to the respondents to evict the pvt. Parties due to reason they have illegally occupied the banzer land without any authority.
Issue a writ, order or direction in the nature of mandamus commanding to the respondents to decide the representation and which has been pending before respondents and also taken a necessary action against the private respondents due to reason without any authority they have encroaches the banzer land."
Sri Krishna Chandra Tripathi, petitioner has come forward to file present Public Interest Litigation, the same is supported by an affidavit of one Sri Yaduvendra Yadav who claims himself to be a close family friend of the petitioner and not of the petitioner himself.
At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the petition.
Accordingly, the petition stands dismissed as withdrawn.
