1. Called in revise. None appeared on behalf of the petitioner to press this writ petition. Learned Standing Counsel is present for respondents.
2. By means of the present writ petition, petitioner has sought following reliefs:
"i. issue a writ, order in the nature of certiorari calling for the record and quashing the order dated 16.12.2000 in so far as it requires the petitioner to submit his application for compassionate appointment in the proforma provided for under Government Order dated 4th September, 2000 and the letter of the Secretary Basic Shiksha Parishad, Uttar Pradesh dated 14.9.2000.
ii. issue a writ, order or direction in the nature of mandamus commanding the respondents Zila Basic Shiksha Adhikari Mirzapur to consider the application of the petitioner for compassionate appointment in accordance with the Rules/Government Order as applicable on the date of death of the mother of the petitioner (i.e. 8.4.1999)/on the date the application for compassionate appointment was filed i.e. 27.5.1999 within one month's of the production of the order of Hon'ble High Court by means of reasons speaking order and further to ensure that the petitioner is offered suitable appointment within one week thereafter and not to insist upon the submission of the application the proforma provided for under the Government Order dated 4th September, 2000."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
